Terms & Conditions

These Terms & Conditions (the “Terms”) govern your use of Exhibit A (the “Service”), operated by Martin Cargeeg, trading as Exhibit A (“we”, “us”, “our”), a UK-based sole trader. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1.What Exhibit A is

Exhibit A is a personal trading-journal and analytics tool. It helps you record, review, plan and analyse your own trades — including a journal, missed-trade log, position-size calculator, analytics and charts, an economic-events calendar, and a gallery of chart screenshots you supply. It is a productivity and record-keeping tool for your own use.

3.Acceptable use

You agree to use the Service lawfully and only for its intended purpose. In particular, you agree not to:

• use the Service in breach of any applicable law or regulation;
• attempt to gain unauthorised access to, disrupt, or reverse-engineer the Service or its infrastructure;
• upload content that is unlawful, infringing, or that you do not have the right to share;
• resell, sublicense, or redistribute the Service without our written permission; or
• use the Service in a way that could damage, disable or overburden it.

4.Accounts and early access

To use certain features you create an account with your email address. You are responsible for keeping your login details secure and for all activity under your account. You must be at least 18 years old to use the Service.

The Service is currently in free early access: every feature is available at no charge, with no card required and no time limit. We may introduce paid plans in future; if we do, early-access users will receive fair advance notice and the opportunity to take up founding terms before any charge applies. Nothing you have logged will be removed or held back if paid plans are introduced.

5.Plans, pricing and billing

No paid plans are on sale today. When paid plans launch, we currently plan to offer:

• Elite subscription — £19 per month, or £190 per year (two months free).

Planned prices may change before launch and will be confirmed at the point of purchase. All prices are in pounds sterling (GBP) and, unless stated otherwise, are inclusive of any applicable taxes. Payments will be processed securely by Stripe; we will not store your full card details. Subscriptions will renew automatically at the end of each billing period until cancelled. By subscribing, you authorise us and Stripe to charge the applicable fee on each renewal.

6.Cancellation and refunds

These terms apply once paid plans are available. You will be able to cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access until then. We do not provide pro-rata refunds for partial periods unless required by law.

As a UK consumer buying digital content, you have a 14-day right to cancel, unless you have asked for and consented to immediate access — in which case that cancellation right may end once access begins. Separately, we offer a 30-day money-back guarantee on paid plans as a goodwill measure. Purchases that are faulty or not as described remain covered by your statutory rights regardless. 7.Your data and content

You retain ownership of the trades, notes, journal entries and other content you enter. You grant us the limited right to store and process that content solely to provide the Service to you. How we handle personal data is described in our Privacy Policy.

8.Availability and changes to the Service

We aim to keep the Service available and reliable, but we provide it “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We may add, change, suspend or remove features, and we may rely on third-party providers whose availability we do not control.

9.Limitation of liability

To the fullest extent permitted by law, we are not liable for any trading losses, lost profits, or indirect, incidental, special or consequential losses arising from your use of (or inability to use) the Service, or from reliance on any information or output it produces. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.

10.Ending your access, and ours

You can stop using the Service at any time. To close your account and have your data deleted, email us at support@exhibit-a-trading.com from the address on the account. We will action it within 30 days and confirm when it is done.

We may suspend or end your access if you materially breach these Terms, use the Service unlawfully, attempt to disrupt or gain unauthorised access to it, or (once paid plans exist) fail to pay. Where it is reasonable to do so we will warn you first and give you a chance to put things right; for serious or repeated breaches, or where there is a risk to other users or to the Service, we may act immediately.

The Service is currently in early access and provided free of charge. We may change, pause or withdraw it. If we decide to withdraw it altogether we will give you at least 30 days’ notice by email and keep your data available to export throughout that period. Nothing in this section affects any commitment we have separately made to founding users about continued free access to core features.

When your access ends, your right to use the Service stops immediately. Unless you ask us to delete it sooner, we will keep your account data for 30 days so you can export it, and delete it after that. Sections covering your data and content, limitation of liability, and governing law continue to apply after your access ends.

11.Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

12.Governing law

These Terms and any dispute arising from them are governed by the laws of England & Wales, and the courts of England & Wales have non-exclusive jurisdiction. Nothing in this clause affects your mandatory rights as a consumer to bring proceedings in your country of residence.

13.Trademarks

Excel, Google Sheets, Notion, Forex Factory, TradingView and OANDA are trademarks of their respective owners; Exhibit A is not affiliated with, endorsed by, or sponsored by them.
