Terms & Conditions
These Terms & Conditions (the “Terms”) govern your use of Exhibit A (the “Service”), operated by Martin Cargeeg, trading as Exhibit A (“we”, “us”, “our”), a UK-based sole trader. By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1.What Exhibit A is
Exhibit A is a personal trading-journal and analytics tool. It helps you record, review, plan and analyse your own trades — including a journal, missed-trade log, position-size calculator, analytics and charts, an economic-events calendar, and a gallery of chart screenshots you supply. It is a productivity and record-keeping tool for your own use.
2.Not financial, investment or trading advice
Exhibit A does not provide financial, investment, trading, tax or legal advice, and nothing in the Service is a recommendation to buy, sell or hold any instrument. All figures, analytics, scores and outputs are informational only and are based on the data you enter. Trading carries a high risk of loss. Past performance is not indicative of future results and no particular outcome, profit or performance is guaranteed. You are solely responsible for your own trading decisions, and you should seek independent professional advice where appropriate.
3.Acceptable use
You agree to use the Service lawfully and only for its intended purpose. In particular, you agree not to:
- use the Service in breach of any applicable law or regulation;
- attempt to gain unauthorised access to, disrupt, or reverse-engineer the Service or its infrastructure;
- upload content that is unlawful, infringing, or that you do not have the right to share;
- resell, sublicense, or redistribute the Service without our written permission; or
- use the Service in a way that could damage, disable or overburden it.
4.Accounts and the free trial
To use certain features you create an account with your email address. You are responsible for keeping your login details secure and for all activity under your account. You must be at least 18 years old to use the Service.
We may offer a free trial (currently 14 days). The trial lets you use the paid features for the trial period at no charge. We may change or withdraw trial terms at any time. At the end of the trial, continued access to paid features requires a paid plan.
5.Plans, pricing and billing
The Service is offered on the following paid plans:
- Elite subscription — £19 per month, or £190 per year.
- Founding-member lifetime licence — a one-time payment of £97 granting lifetime access, limited to the first 50 founding members. Once 50 founding licences have been taken up, this offer closes.
All prices are in pounds sterling (GBP) and, unless stated otherwise, are inclusive of any applicable taxes. Payments are processed securely by Stripe; we do not store your full card details. Subscriptions renew automatically at the end of each billing period until cancelled. By subscribing, you authorise us and Stripe to charge the applicable fee on each renewal.
6.Cancellation and refunds
You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access until then. We do not provide pro-rata refunds for partial periods unless required by law.
As a UK consumer buying digital content, you have a 14-day right to cancel, unless you have asked for and consented to immediate access — in which case that cancellation right may end once access begins. Separately, we offer a 30-day money-back guarantee on paid plans as a goodwill measure. Purchases that are faulty or not as described remain covered by your statutory rights regardless. 7.Your data and content
You retain ownership of the trades, notes, journal entries and other content you enter. You grant us the limited right to store and process that content solely to provide the Service to you. How we handle personal data is described in our Privacy Policy.
8.Availability and changes to the Service
We aim to keep the Service available and reliable, but we provide it “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We may add, change, suspend or remove features, and we may rely on third-party providers whose availability we do not control.
9.Limitation of liability
To the fullest extent permitted by law, we are not liable for any trading losses, lost profits, or indirect, incidental, special or consequential losses arising from your use of (or inability to use) the Service, or from reliance on any information or output it produces. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
10.Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
11.Governing law
These Terms and any dispute arising from them are governed by the laws of England & Wales, and the courts of England & Wales have non-exclusive jurisdiction. Nothing in this clause affects your mandatory rights as a consumer to bring proceedings in your country of residence.
12.Trademarks
Excel, Google Sheets, Notion, Forex Factory, TradingView and OANDA are trademarks of their respective owners; Exhibit A is not affiliated with, endorsed by, or sponsored by them.
