Terms & Conditions

These Terms & Conditions (the “Terms”) govern your use of Exhibit A (the “Service”), operated by Martin Cargeeg, trading as Exhibit A (“we”, “us”, “our”), a UK-based sole trader. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1.What Exhibit A is

Exhibit A is a personal trading-journal and analytics tool. It helps you record, review, plan and analyse your own trades — including a journal, missed-trade log, position-size calculator, analytics and charts, an economic-events calendar, and a gallery of chart screenshots you supply. It is a productivity and record-keeping tool for your own use.

3.Acceptable use

You agree to use the Service lawfully and only for its intended purpose. In particular, you agree not to:

• use the Service in breach of any applicable law or regulation;
• attempt to gain unauthorised access to, disrupt, or reverse-engineer the Service or its infrastructure;
• upload content that is unlawful, infringing, or that you do not have the right to share;
• resell, sublicense, or redistribute the Service without our written permission; or
• use the Service in a way that could damage, disable or overburden it.

4.Accounts, trials and existing users

To use certain features you create an account with your email address. You are responsible for keeping your login details secure and for all activity under your account. You must be at least 18 years old to use the Service.

Free trial. New accounts include a 14-day free trial of the full Service. No payment details are required to start the trial, and nothing is charged during it. The trial begins when the account is created. We will email you before it ends.

When the trial ends. If you have not subscribed by the end of the 14 days, your account moves to a read-only period of 7 days. During that period you can still sign in, view everything you have recorded and export your data, but you cannot add new entries. After the read-only period, sign-in to the journal is suspended until you subscribe. We do not delete your data because a trial ended — it is retained in line with section 9 and is restored in full if you subscribe later. You may request a copy of your data at any time, including after the read-only period, by contacting support@exhibit-a-trading.com.

No subscription begins, and no payment is ever taken, unless you actively choose a plan and complete checkout.

Existing users. Accounts created during our free early-access period retain full access to the Service at no charge, permanently. This applies to the account as it stood at the end of early access and does not require any action from you.

The position size calculator remains free to use, with no account and no payment details required.

5.Plans, pricing and billing

The Service is offered on a single paid plan, which includes every feature:

• Full access — £19 per month, or £190 per year (equivalent to two months free).

Prices are confirmed at the point of purchase and any change will be notified in advance. All prices are in pounds sterling (GBP) and, unless stated otherwise, are inclusive of any applicable taxes. Payments are processed securely by Stripe; we do not store your full card details. Subscriptions renew automatically at the end of each billing period until cancelled. By subscribing, you authorise us and Stripe to charge the applicable fee on each renewal.

6.Cancellation and refunds

You can cancel a subscription at any time from within your account. Cancellation takes effect at the end of the current billing period, and you retain access until then. We do not provide pro-rata refunds for partial periods unless required by law.

As a UK consumer buying digital content, you have a 14-day right to cancel, unless you have asked for and consented to immediate access — in which case that cancellation right may end once access begins. Separately, we offer a 30-day money-back guarantee on paid plans as a goodwill measure. Purchases that are faulty or not as described remain covered by your statutory rights regardless. 7.Your data and content

You retain ownership of the trades, notes, journal entries and other content you enter. You grant us the limited right to store and process that content solely to provide the Service to you. How we handle personal data is described in our Privacy Policy.

8.Availability and changes to the Service

We aim to keep the Service available and reliable, but we provide it “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We may add, change, suspend or remove features, and we may rely on third-party providers whose availability we do not control.

9.Limitation of liability

To the fullest extent permitted by law, we are not liable for any trading losses, lost profits, or indirect, incidental, special or consequential losses arising from your use of (or inability to use) the Service, or from reliance on any information or output it produces. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.

10.Ending your access, and ours

You can stop using the Service at any time. To close your account and have your data deleted, email us at support@exhibit-a-trading.com from the address on the account. We will action it within 30 days and confirm when it is done.

We may suspend or end your access if you materially breach these Terms, use the Service unlawfully, attempt to disrupt or gain unauthorised access to it, or (once paid plans exist) fail to pay. Where it is reasonable to do so we will warn you first and give you a chance to put things right; for serious or repeated breaches, or where there is a risk to other users or to the Service, we may act immediately.

We may change, pause or withdraw the Service. If we decide to withdraw it altogether we will give you at least 30 days’ notice by email and keep your data available to export throughout that period. Nothing in this section affects the permanent free access committed to early-access accounts under section 4, or your rights to a refund for any period paid for but not provided.

When your access ends, your right to use the Service stops immediately. Unless you ask us to delete it sooner, we will keep your account data for 30 days so you can export it, and delete it after that. Sections covering your data and content, limitation of liability, and governing law continue to apply after your access ends.

11.Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

12.Governing law

These Terms and any dispute arising from them are governed by the laws of England & Wales, and the courts of England & Wales have non-exclusive jurisdiction. Nothing in this clause affects your mandatory rights as a consumer to bring proceedings in your country of residence.

Excel, Google Sheets, Notion, Forex Factory, TradingView and OANDA are trademarks of their respective owners; Exhibit A is not affiliated with, endorsed by, or sponsored by them.
